Supreme Court case announcements, 6/21/17

Just two new grants today--one of which we've discussed before.

Sunoco Pipeline LP v. Teter relates to the taking of private property for the construction of a for-profit pipeline. Readers may recall that I was interested in the appellant's third proposition of law, relating to whether the appropriation was "necessary" within the meaning of the statute, and it seemed likely that the Court would accept the case because it had stayed the Seventh District's judgment. Alas, the Court did not accept the necessity issue, and will take up only an issue relating to whether natural gas constitutes "petroleum" within the meaning of the statute.

State v. Moore asks whether R.C. 2929.14(B)(1)(b), which prohibits early release or other reduction of sentences imposed for felony convictions with firearm specifications, violates the Equal Protection Clause. According to the State, the Sixth District sua sponte determined that it did, and then certified its decision as being in conflict with the Seventh District's decision in State v. Furrie.

Still no action on either of my cases pending at the jurisdictional stage. The next orders day is expected to be July 5.
