Supreme Court case announcements, 10/26/16

The Court has accepted two new cases for review.

State v. Mobarak, an appeal out of the Tenth District, was accepted and held for the decision in State v. Shalash. The question in Shalash is whether "controlled substance analogs" were criminalized effective as of October 2011 (when the "trafficking in controlled substances" statute took effect) or December 2012 (when the phrase "controlled substance analog" was added to the statute). Shalash was argued in August and I believe we may receive a decision before Justice Pfeiffer and Justice Lanzinger retire at the end of this month.

The Court also accepted Toledo v. State, which presents the question of whether Ohio's traffic-camera statutes are "general laws" and as such displace conflicting municipal ordinances related to traffic cameras. The case has been held for the decision in Dayton v. State, which will be argued on January 10.
